The Cooperative Swimming Certification Program (CSCP) provides educational materials, certification processes, and licensing standards designed to promote knowledge of water safety, compliance, and best practices in water-related environments.
By using the CSCP website, obtaining a certification (Tier 1), or obtaining a license (Tier 2 or Tier 3), you explicitly agree to this Disclaimer.
2. Disclaimer of Physical Ability and Guarantee of Safety
2.1 Certification Limitation
The CSCP Swimming Certification (Tier 1) verifies that an individual has successfully passed a knowledge-based assessment related to fundamental safety protocols. It is not, and shall not be interpreted as, a certification of physical ability, swimming proficiency, or overall physical fitness.
2.2 No Guarantee of Safety
CSCP does not guarantee safety, and safety remains the sole responsibility of the individual engaging in water activities and/or the organization operating the facility. Use of the CSCP services or standards does not eliminate the inherent risks associated with swimming, diving, or being near water. You assume all risk and liability for any injury, accident, death, or property damage that may occur.
2.3 Medical Waiver
The content, curriculum, and safety standards provided by CSCP are not substitutes for professional medical, legal, or emergency advice. Always seek the advice of a qualified healthcare professional, local emergency services, and legal counsel with any questions you may have.
3. Disclaimer Regarding Licensed Instructors and Facilities (Third Parties)
3.1 Non-Affiliation
Licensed Instructors (Tier 2) and Licensed Facilities (Tier 3) are independent entities and are not employees, agents, or partners of CSCP. CSCP licenses them to use the curriculum and safety standards, but does not control their day-to-day operations or personal conduct.
3.2 Responsibility for Conduct
CSCP expressly disclaims all responsibility and liability for the professional competence, actions, errors, omissions, negligence, or outcomes associated with any Licensed Instructor or Licensed Facility. This includes, but is not limited to, the quality of instruction, the safety conditions of the facility, and any injuries or damages arising from their direct or indirect services.
3.3 Facility Liability
A Licensed Facility (Tier 3) retains sole and absolute responsibility for the safety and maintenance of its premises, equipment, and staff. CSCP’s safety standards are advisory, and the Facility’s compliance is its own responsibility.
4. Accuracy of Information
4.1 Content Status
While CSCP makes reasonable efforts to ensure the accuracy and currency of the content, curriculum, and certification materials, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the information provided on our website or through our services.
4.2 Local Regulation
Safety and operational requirements are governed by various local, regional, and national laws. The CSCP curriculum and standards are global recommendations, but they may not satisfy all requirements in every jurisdiction. It is the user’s responsibility to ensure compliance with all applicable local regulations and legal mandates.
